1. Acceptance of Terms
By accessing or using the Alphola website and its affiliated platforms (collectively, the "Platform", as further described in Section 2 below), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please discontinue use of the Platform immediately.
For the purposes of these Terms:
"User" means any person, or any authorized representative acting on behalf of a legal entity, who accesses or uses the Platform, including any visitor.
"Client" means any legal entity that purchases or engages Alphola's services pursuant to a separate service agreement ("Service Agreement") entered into with Alphola.
"User" and/or "Client" may be referred to collectively as "you", unless the context otherwise requires. For the purposes of these Terms, the "Platform" may also be referred to as the "Services" where the context requires.
Alphola Media Group Sdn. Bhd. ("Alphola", "we", "us" or "our") reserves the right to modify these Terms at any time. Any changes will be effective upon posting on the Platform or notifying you through other means. However, any modification shall not affect an executed Service Agreement unless mutually agreed in writing by both parties.
2. About the Platform and Services
Alphola operates as a media hub and content publishing platform, managing a portfolio of affiliated financial media websites including, but not limited to, Gotradehere.com, tradewithauntie.com, traderbobo.com, Thaiforexreview.com, Monetyra.com, Toshinfo.com, Teininvest.com, Asia-Biz.com, Brokerspecs.com, and Traderforum.com. These platforms focus primarily on financial and trading-related content, including broker reviews, market commentary, and related editorial material.
Alphola's primary service is the creation and publication of review articles for financial service businesses, including brokers, trading platforms, and related financial service providers, across its affiliated websites. Articles are written by Alphola based on information supplied by the Client. The detailed scope of services, article preparation process, and related obligations are governed by the applicable Service Agreement.
Alphola acts solely as a content publisher. Alphola does not independently verify the information provided by Clients, does not endorse any financial product or service featured in published articles, and does not provide financial advice, investment recommendations, or regulatory guidance of any kind.
3. Eligibility and Service Engagement
To engage Alphola's services through the Platform, you represent and warrant that you are a legally registered business entity with full authority to enter into binding agreements, that you hold all necessary regulatory licenses and authorizations required to conduct your business, and that all information and materials you provide to Alphola are accurate, complete, lawful, and do not infringe any third-party rights.
Engagement with Alphola is subject to internal due diligence and compliance review. All service engagements shall be governed by a separate Alphola Service Agreement executed between Alphola and the Client. These Terms shall be read together with and form part of any applicable Service Agreement. In the event of any inconsistency between these Terms and the Service Agreement, the terms of the Service Agreement shall prevail.
4. Client Responsibility
Clients using the Platform and engaging Alphola's services agree to provide accurate, complete, and up-to-date information; to notify Alphola promptly of any material changes to their corporate structure, ownership, regulatory status, or business activities; and to ensure that all content submitted for publication is lawful, accurate, and compliant with applicable laws and regulations.
Clients shall not engage in or promote any of the following:
- False or misleading advertising.
- Illegal financial activities or unauthorized fund collection.
- Ponzi schemes or fraudulent investment schemes.
- Unauthorized investment solicitation.
- Guarantees or commitments regarding investment returns.
- Misrepresentation of trading or past performance.
- Trading on behalf of clients without proper authorization.
Failure to comply with the above shall constitute a material breach of these Terms and the applicable Service Agreement, entitling Alphola to suspend or terminate the engagement with immediate effect. All payments made shall remain non-refundable.
5. Content Disclaimer
Articles published on Alphola's affiliated platforms are paid review articles produced on behalf of the Client. Such content is prepared based solely on information provided by the Client and does not represent the independent opinion or editorial view of Alphola.
Nothing published on the Platform or any affiliated website constitutes financial, investment, legal, or regulatory advice. All content is for informational purposes only. Users are strongly advised to conduct their own due diligence and seek advice from qualified financial professionals before making any investment or trading decisions.
Publication of a review article does not constitute Alphola's endorsement, recommendation, or verification of any broker, trading platform, financial product, or service. Alphola does not guarantee the performance, reliability, or regulatory compliance of any entity featured in published content. Alphola makes no representation regarding the regulatory status, licensing, or legal standing of any broker or financial services provider featured on its platforms.
Trading and investing in financial markets involve substantial risk of loss and may not be suitable for all individuals. Past performance is not indicative of future results. Users should verify the regulatory status and licensing of any financial service provider with the relevant regulatory authorities in their jurisdiction before engaging their services.
6. Intellectual Property
All content, articles, reviews, creative works, formats, methodologies, templates, and material created by Alphola in connection with the Services shall remain the sole and exclusive property of Alphola. Clients may be granted a limited license to use delivered content as set out in the applicable Service Agreement. No content from the Platform may be reproduced, modified, distributed, or commercially exploited without Alphola's prior written consent.
7. Alphola's Rights
Alphola reserves the right, at its sole discretion and without prior notice, to:
- Suspend, restrict, or remove any published content where compliance, legal, or reputational concerns arise.
- Decline or terminate any client engagement that may expose Alphola to material risk.
- Withhold publication pending resolution of outstanding compliance matters.
- Terminate any Service Agreement in accordance with the terms thereof.
The exercise of these rights shall not give rise to any refund obligation.
8. Limitation of Liability
To the fullest extent permitted by applicable law:
- Alphola's total aggregate liability to any Client shall not exceed the total service fee actually paid under the applicable Service Agreement.
- Alphola shall not be liable for any indirect, incidental, consequential, special, punitive, or reputational damages, loss of profit, or loss of business, whether arising in contract, tort, or otherwise.
- Alphola shall not be liable for any loss or damage arising from any User's or third party's reliance on content published on the Platform or affiliated websites.
- Nothing in these Terms excludes liability for fraud or willful misconduct.
9. Confidentiality
Each party acknowledges that in the course of engagement, it may have access to confidential information of the other party. Each party shall maintain the confidentiality of such information and shall not disclose it to third parties without prior written consent of the disclosing party, except where (i) the information becomes publicly available without breach of these Terms, (ii) it is lawfully obtained from a third party without restriction, or (iii) it is required to be disclosed by applicable law or court order. This obligation shall survive termination of any Service Agreement. Further confidentiality provisions, where applicable, shall be set out in the Service Agreement.
10. Data Protection
Each party shall comply with all applicable data protection and privacy laws. The Client represents and warrants that any personal data provided to Alphola has been lawfully obtained and may be used for the purposes of the engagement. The Client shall indemnify Alphola against any claim arising from the Client's breach of applicable data protection laws. For detailed information on how Alphola collects, uses, and processes personal data, please refer to Alphola's Privacy Policy, which forms an integral part of these Terms.
11. Prohibited Use
Users of the Platform agree not to:
- Use the Platform for any unlawful purpose or in violation of applicable laws and regulations.
- Scrape, copy, reproduce, or commercially exploit any content from the Platform without Alphola's written consent.
- Attempt to gain unauthorized access to any part of the Platform or its systems.
- Upload or transmit any harmful, defamatory, or infringing content via the Platform.
12. Third-Party Links
The Platform may contain links to third-party websites. Alphola does not endorse or assume responsibility for the content, products, or services of any third-party website. Access to third-party websites is at the User's own risk.
13. Termination of Access
Alphola reserves the right to suspend or terminate any User's or Client's access to the Platform at any time, with or without notice, where Alphola determines that these Terms have been violated or where continued access poses a compliance or reputational risk to Alphola.
14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Malaysia. The courts of Malaysia shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms.

These Terms of Use are subject to change at any time at Alphola's sole discretion. Alphola encourages all Users and Clients to review these Terms periodically. Continued access to the Platform following any update constitutes acceptance of the revised Terms.
